Today, Balda AG’s Supervisory Board agreed with regard to the actuarial
reporting obligation and foreclosure periods terminating as of December 31,
2014, to claim damages on behalf of the company against the former
Supervisory Board Members Dr. Michael Naschke, Yu-Sheng Kai and Chun-Chen
Chen. The Supervisory Board also resolved to include the former sole member
of the Board of Directors, Rainer Mohr, in its claim for damages.
The former Board members are accused of breach of duty in relation to the
intended sale of shares of TPK Holding Co. in July 2011, in that the TPK
shares could only be sold at a later point in time, when their price was
significantly lower. According to current evaluations, the potential
damages amount to a figure in the two-digit million range.
